تحلیل مضمون فقهی و حقوقی کلان داده‌های شبکه‌های اجتماعی در ارزیابی لایحه حمایت از خانواده از طریق ترویج فرهنگ عفاف و حجاب

چکیده

لایحه حمایت از خانواده از طریق ترویج فرهنگ حجاب و عفاف به منظور پاسداری از ارزش‌های اجتماعی و با هدف مشارکت حاکمیت و مردم در حفظ سلامت جامعه، به ویژه ترویج حجاب، تدوین شده است . بنا به اهمیت موضوع لایحه و همچنین حساسیت آحاد جامعه نسبت به کم‌وکیف وضع سیاست در حوزه حجاب، تدقیق محتوا و سیاست‌های مندرج در لایحه پیشنهادی، ضروری می‌نماید. فارغ از ایرادات و ابهامات فقهی حقوقی که توسط نخبگان علمی به لایحه عفاف و حجاب وارد است؛ نوع مواجهه مردم که ممکن است آگاهی کامل بر این لایحه نداشته‌باشند، مهم است؛ زیرا برای اجرای یک قانون حمایت فرهنگی و توافق اجتماعی نیاز است. تحلیل داده‌های پژوهش که باروش تحلیل مضمون کلان‌داده‌های تولید شده توسط کاربران شبکه‌های اجتماعی توئیتر، اینستاگرام و تلگرام صورت‌گرفته، بیانگر این امر است که برخی کاربران، لایحه حجاب و عفاف را باکرامت انسانی و عدالت اجتماعی در تضاد دانسته و یکی از ابهامات پرتکرار در میان آنان، بحث عدم‌شرعی بودن قراردادن مجازات برای بی‌حجابی است. برخی به عدم دخالت اکثریت مردم در تدوین لایحه اشاره و با بیان درآمدزایی دولت به‌وسیله جریمه‌های نقدی در لایحه، آن را سوءاستفاده دولت از حق حاکمیتی خود می‌دانند. عده‌ای نوع کشف جرم در لایحه را با حریم خصوصی افراد در تناقض دانسته، آن را غیرمشروع می‌دانند. بعضی معتقدند اجرای لایحه حجاب، منجر به دوقطبی‌سازی در جامعه شده و در نهایت عده‌ای ایرادات شکلی به لایحه وارد کرده‌اند که در این مقاله به‌نقد، تحلیل و بررسی فقهی و حقوقی موارد فوق پرداخته شده‌است.

The 'Bill for the Protection of Family through the Promotion of Hijab and Modesty Culture' has been drafted with the aim of safeguarding social values and fostering government and public participation in maintaining societal health, particularly promoting hijab [C1]. Given the significance of this bill and the public's sensitivity to the nuances of policy-making in the realm of hijab, it is imperative to refine the content and policies outlined in the proposed bill. Beyond the legal and jurisprudential shortcomings identified by academic experts, the public's reaction, who may not have a complete understanding of the bill, is crucial. This is because the enforcement of a cultural protection law requires social consensus. An analysis of data from a large-scale content analysis of user-generated data on social media platforms such as Twitter, Instagram, and Telegram reveals that some users perceive the hijab and modesty bill as being in conflict with human dignity and social justice. One frequently raised question is the lack of a legal basis for imposing penalties for not wearing a hijab. Some users point to the lack of public involvement in drafting the bill and argue that the government's generation of revenue through fines constitutes an abuse of its sovereign power. Others consider the methods of crime detection outlined in the bill to be a violation of individual privacy and thus illegitimate. Some believe that the implementation of the hijab law will lead to polarization within society, while others have raised formal objections to the bill. This article provides a critical analysis and jurisprudential and legal examination of the aforementioned points
